CONTEST RULES – OFFICIAL RULES

 

• Eligibility

 

The BIRTHRIGHT ALUMNI PHOTO CONTEST (the “CONTEST”) is open to Hillel Ontario full time students only. INDIVIDUALS MUST BE 18 YEARS OF AGE or older to be able to participate in the Contest and claim any of the prizes. EMPLOYEES OF HILLEL ONTARIO and members of their respective families are ineligible to participate in the contest. EMPLOYEES OF ANY SPONSOR or agency involved with the contest are ineligible to participate in the contest, as are members of their respective families.

The Contest Sponsor is ElAl Israel Airlines

No purchase necessary to enter or win. A purchase will not increase your chance of winning. The act of entering the Contest constitutes acceptance of the Contest Rules and decisions of the Contest judge.

 

• How to Enter

 

If you wish to participate in the Contest and be eligible for one of the Prizes, kindly visit us at http://hillelontario.wpengine.com/photo-contest/ between Monday, February 6, 2017 at 1:00 PM Eastern Standard Time (EST) and Wednesday February 15, 2017 at 12:00 PM EST. (the “Contest Period”) and enter the required information, include a photograph (the “Entry”).

To be eligible to win a prize in the Contest, you must submit Entry before Wednesday, February 15, 2017 at 12:00 PM EST. Upon submission of the Entry online, you will be automatically entered in the Contest, subject to the qualifications in the eligibility criteria. Photographs must be submitted in .jpeg, .jpg or .png format, at least 600 x 600 pixels wide.

The Contest is void where prohibited by law. Contestants who reside in areas where the Contest is prohibited by law may participate in the Contest but will be ineligible for the prizes. Chances of winning depend on the total number of eligible entries received.

Limit two (2) entries per person. All entries from individuals found to have entered more than twice will be void. In the event of a dispute over the identity of a potential winner, the potential winner may be required to provide identification sufficient to show that he/she is the person identified on the entry submission and is otherwise eligible to win.

Hillel Ontario is not responsible for any lost, late, illegible, incomplete, falsified, destroyed, or failed entries, or for any electronic miscommunications or failures of any kind, which may limit an entrant’s ability to participate in this Contest. Proof of submitting an entry is not proof of receipt by Hillel Ontario. All entries become the property of Hillel Ontario and will not be acknowledged or returned. Any and all lost, late, illegible, incomplete, falsified, destroyed, or failed entries will be

disqualified.

Agreement

No purchase is necessary to enter or win the Contest. The act of entering the Contest constitutes acceptance of the Contest Rules and decisions of the Hillel Ontario’s judges.

 

• Use of Entry

 

Without limiting the foregoing, by submitting photography, photographs, images, and any other documents as part of your entry (the “Art”)  to the Contest, you grant Hillel Ontario (and any of its employees, agents, or assigns) full non-exclusive use of the Art, including the right to display, distribute, reproduce and create derivative works of the Art, in whole or in part, in any media now existing or later developed, for any Hillel Ontario purpose, including, but limited to, advertising and promotion of Hillel Ontario and its website, social media and marketing materials. Hillel Ontario will not be required to pay any additional consideration or seek any additional approval in connection with such uses.

By participating in this Contest, you agree that any photograph submitted with an entry may be reproduced by Hillel Ontario without a photographer credit.

 

• Lawful Photography of Individuals

 

If you choose to include people in your entry, you are responsible for obtaining the necessary releases from the individuals depicted, and must be able to provide copies of those releases to Hillel Ontario, upon request.

To be eligible to participate in the Contest, you must follow all local, provincial, and federal laws and regulations regarding the taking and possession of the Art you are submitting to the Contest.

 

• Judging

 

Entries will be judged based on the quality of the photo, if the photo captures the “Birthright Experience” and originality. A panel of judges at Hillel Ontario will select 10 (ten) entries (the “Finalists”) and put them in a photo album on Hillel Ontario’s Facebook Page.

Members of the public will then vote on their favourite entry of the Finalists between Monday February 20, 2017 at 10:00 AM PST and Tuesday February 28, 2017 at 11:59 PM EST.

Finalists will not be notified by Hillel Ontario that they are Finalists.

Hillel Ontario will then choose the winning entries by March 1, 2017

 

• Prizing

 

There is total of Four (4) Prizes to be won.

First Prize consists of $650.00 CDN.

Second Prize consists of $250.00 CDN.

Third Prize consists of $100.00 CDN.

Fourth Prize consists of a Gift Card to Aroma Espresso Bar valued at $20.00 CDN.

Hillel Ontario will make reasonable efforts to contact potential winners by telephone (if telephone number provided) and/or email within ten (10) business days following the date of the drawing.

If the potential winner cannot be contacted within the time specified above, does not provide full information requested within fourteen (14) days of his/her being informed of his/her name being drawn, does not correctly answer the mathematical skill-testing question, is not otherwise an eligible entrant, or does not otherwise comply with the Contest Rules, he/she will not win any prize. In this event, the prize will be awarded to an alternate entrant, who will be randomly selected from among the remaining eligible entries. Any alternate winner will have the same rights and obligations as the original winner.

In order to be eligible to win, the selected contestant must correctly answer a mathematical skill testing question and pick up their prize at the Wolfond Centre, 36 Harbord St, Toronto, ON M5S 1G2, during regular business hours.

Without limiting the foregoing, to claim a prize, a potential winner must comply with the Rules for this Contest and must correctly answer unaided a time-limited mathematical skill-testing question administered by Hillel Ontario.

Release: Without limiting the foregoing, prior to receiving any prize, the winner will be required to sign an affidavit of eligibility and release form releasing Hillel Ontario and any sponsors of the Contest from all liability, confirming compliance with these Rules and consenting to the use of his or her name and photograph, without any further compensation, in any publicity carried out by Hillel Ontario and/or their advertising and promotional agencies.

PRIZES ARE NOT TRANSFERABLE and may not be exchanged for other prizes or for cash. A potential winner must comply with the Contest Rules for this Contest.

 

• Confirmation of Potential Winners

 

By participating in the contest, entrants agree to be bound by these Contest Rules and that the decisions made by Hillel Ontario are final and binding in all respects. No cash or other substitution or transfer of prizes is permitted, except that Hillel Ontario reserves the right, in its sole discretion, to substitute a prize of equal or greater value. Return of any prize notification as non-deliverable or failure to comply with the  Contest Rules will result in disqualification, and an alternate entrant may be randomly selected in accordance with the Contest Rules. All taxes for prizes are the sole responsibility of the individual winners.

 

• Personal information

 

Personal information gathered by Hillel Ontario will be used for the purposes of administering the CONTEST, contacting potential winners and as otherwise permitted or required by law.

 

• Miscellaneous

 

INDEMNIFICATION BY ENTRANT

By entering the Contest, entrant releases and holds Hillel Ontario and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Contest, any breach of the Contest Rules, or in any Prize-related activity. The entrant agrees to fully indemnify Hillel Ontario and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any and all claims by third parties relating to the Contest, without limitation.

By participating, entrants agree: (1) that Hillel Ontario may (unless prohibited by law) use entrant’s photograph they submitted to the CONTEST, their name, city of residence, photograph, image and/or likeness for advertising and other promotional purposes, without further review or compensation, in any media, in perpetuity and worldwide; and (2) to hold Hillel Ontario, its, affiliates, advertising and promotion agencies and other agents, and their respective directors, officers, employees, representatives, agents and assigns harmless against any and all claims, loss, liability, injury or damage to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of their acceptance, possession or use of a prize or their participation in this CONTEST.

Problems with Submissions

Hillel Ontario is not responsible for incomplete, lost or late entries or faulty transmissions, technical computer hardware or software failures of any kind, lost or interrupted or unavailable network connections, or failed, incomplete, garbled, misrouted, scrambled or delayed computer transmission, or other errors or problems of any kind, whether mechanical, human, electronic or otherwise, which may limit or affect in any way an entrant’s ability to participate in this CONTEST. Hillel Ontario is not responsible for any typographical or other error in the printing of the offer, administration of this CONTEST or in the announcement of the prizes. Hillel Ontario assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this CONTEST; (c) any

technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation

of this CONTEST; (d) inaccessibility or unavailability of the entry portals on any particular day; or (e) any injury or damage to entrant’s or to any other person’s computer which may be related to or resulting from participating in the CONTEST or any attempt to obtain further information concerning this CONTEST.

Disqualification

Hillel Ontario reserves the right (1) to disqualify any entrant and void any entries of an entrant who has engaged in unsportsmanlike conduct, fraud or other misconduct relative to this CONTEST or otherwise attempted to tamper with or impair this CONTEST; and/or (2) to cancel, modify, suspend or terminate this CONTEST, for any reason, including if, in Hillel Ontario ‘s sole opinion, technical

failures, applicable laws or regulations, virus, bugs, unauthorized human intervention or other cause beyond Hillel Ontario’s control destroys the integrity of this CONTEST or otherwise corrupts or impairs the administration, security, legality, fairness or proper play of this CONTEST or any part thereof. Online entries must be made only by the original, manual keystrokes of the individual entrant. Use of any automated system including robotic, or form filling software to enter is prohibited and will result in disqualification of all entries by anyone using such assistance.

Hillel Ontario also reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of this CONTEST, or to be acting in any manner Hillel Ontario deems to be in violation of the Contest Rules or disruptive, or with intent to annoy, abuse, threaten or harass any other person. If, for any reason, this CONTEST is not capable of running as planned for reasons which may include, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, violation of applicable law or regulation or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this CONTEST, Hillel Ontario reserves the right at its sole discretion to cancel, terminate, modify or suspend this CONTEST in whole or in part.

Copyright

By uploading any photograph or Art to this contest, you grant (or warrant that the owner of such materials expressly grants) Hillel Ontario wide, royalty-free, irrevocable and non-exclusive right and license to use, copy, adapt, transmit, communicate, publicly display and perform, distribute and create compilations and derivative works or merchandise from any such submitted photograph or Art to promote the contest. You represent and warrant that you have the right to grant the license set out above.

Responsibility

Hillel Ontario is not responsible for any failure of the website during this contest. Nor is it responsible for any problems or technical malfunctions of computer online systems, servers, access providers, computer equipment, software or any e-mail, online or internet entry lost due to technical problems or traffic congestion on the internet or at any website or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in the promotion.

CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, HILLEL ONTARIO RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute regarding who submitted an entry, the entry will be deemed to have been submitted by the authorized account holder of the email address submitted on the entry form at the time of entry.

Other

The CONTEST is subject to all federal, provincial and municipal laws. The CONTEST and the Contest Rules will be exclusively governed and construed in accordance with the laws of the province of Ontario, Canada. Any dispute arising hereunder shall be governed by the laws of Ontario and shall be adjudicated in the applicable court in Toronto, Ontario, Canada.

All information collected will be used for the purposes of administering the Contest and for Hillel Ontario’s internal marketing purposes only and will not be sold or rented to third parties. All personal information collected by Hillel Ontario will be kept in accordance with relevant privacy laws and regulations.

Hillel Ontario is not responsible for lost entries. All decisions of the Contest judges are final. Hillel Ontario reserves the right to cancel or modify the Contest or the Contest Rules at any time without notice.

Hillel Ontario reserves the right to substitute any prize or portion of the prize with a prize of equal or greater value. All prizes are awarded as-is and no warranties or guarantees are implied or expressed. All prizes are non-negotiable, non-transferable, and are not convertible to cash.

Hillel Ontario is not liable for any errors or negligence that may arise in connection with this Contest.
